Terms and Conditions

Effective Date: -- 08th Nov 2017 TERMS & CONDITIONS
OF THE #CashlessBano (Win It for India) CAMPAIGN

1. Mastercard India Services Pvt. Ltd. (“Mastercard”)  and Confederation of All India Traders (CAIT) is conducting The #CashlessBano (Win It for India ) Campaign (the “Campaign”) during the period from 8th Nov 2017 17:00 hours (Indian Standard Time) to 26th January 2018 12: 00 (Indian Standard Time) (the “Campaign Period”).

2. The Campaign is open to the Participants (as hereinafter defined). The following persons are not eligible to participate in the Campaign:-

i. The employees (whether permanent or temporary) of Mastercard and officers of CAIT and its respective subsidiaries, affiliates and holding companies;

ii. The employees (whether permanent or temporary) of Mastercard’s promotion agencies, and other entities involved in the conduct, implementation and/or administration of the Campaign (as determined by Mastercard in its sole discretion); and

iii. The immediate family members of each such employee. For the purposes hereof, “immediate family members” includes spouse, parents, children (including adopted children and step-children), brothers, sisters and the spouse of the children, brothers or sisters.

3. Forthe purposes of these terms and conditions:-

i. “Card” means a valid Mastercard debit or credit card issued in India

ii. “Contest entry” means any person who uses a Mastercard is eligible to be a part of the contest/ luck draw. Additionally, a transaction on a merchant’s Point Of Sale machine will be considered as a part of the contest/ lucky draw in case a Mastercard is used on the POS machine. Mastercard data will have the repository of the contest entries to the Campaign and the site winitforindia.in will have a link to the terms and conditions of the Campaign;

iii. “Mastercard Group and CAIT” refer collectively to the group of subsidiaries, affiliates, holding companies, associated entities, whether incorporated or not as well as agencies of Mastercard and CAIT;

iv. “Eligible Participant or Participant” means an individual who:

·      is a resident  in India; and
·      is of the age of 18 years and above; and
·      has a Card which is valid and in good standing; and
·      participates in the Campaign by submitting a Qualifying Entry (as hereinafter defined).
·      And/or a merchant/ business owner registered with GST details and has a license to operate in India and uses a Mastercard Card on their POS machine or Bharat QR.

v. “Prizes” means, collectively, the Grand Prize and the Minor Rewards, and the expression “Prize” means any of them;

vi. “Qualifying Entry” means anyone who has used a Mastercard Card to do a transaction online, POS, Bharat QR, Near Field Communication and any merchant who has accepted Mastercard Card for any transaction  during the period of 8th Nov 2017- 26th Jan 2018;

vii. “winners” means, collectively, the winners of the Prizes, and the expression “winner” means any of them.

viii “ Prize Administrator” means Mastercard’s internal operations team along with a third party  that will decide the winners basis a logical query run on the data that is captured for all the transactions done in the period 8th Nov 2017- 26th Jan 2018. Winners will be announced on 26th January 2018.

4. To participate in the Campaign, a Participant must be:

i. A consumer who should transact via a card powered by Mastercard.

ii. A merchant who should accept Mastercard Card for any kind of payment.

5. Participants must meet the following eligibility criteria in order to be eligible to participate in the Campaign (collectively the “Eligibility Criteria”):

i. The Participant should transact via Mastercard Card and merchants should accept payments via Mastercard Card;

ii. Qualifying Entries will be the transactions till by 12:00 hours Indian Standard Time on 26th January 2018 in order to stand a chance to win the Grand Prize and Minor Rewards. All transactions across  India within the specified time period will be part of this contest.

To determine the winners of the Campaign, Mastercard will appoint the Prize Administrator who will select the winner through a random draw.

6. The following are the minor rewards:

i. Level 1- Upto 100 transaction: 50 prizes worth INR 5,000 for both merchants and associated cardholder for the transaction.

ii. Level 2- 100-200 transactions: 10 prizes worth INR 10,000 for both merchants and associated cardholder for the transaction.

iii. Level 3- 200- 500 transactions: 10 gold coins for both merchants and associated cardholder for the transaction.

7. There will a total of two (2) “Grand Prizes”- Each Grand Prize – will be a travel voucher for 4Days/3Nights worth INR 50,000/- in value.

8. The Grand Prize is subject to the following terms and conditions:-

i. The Grand Prize fulfilment period for the Grand Prize winner will be in Feb 2018. In order to receive the Grand Prize, the Grand Prize winner will be required to redeem the travel voucher within three (3) months of the voucher.

ii. The Grand Prize winner must sign a CAIT  acknowledgment form agreeing to, amongst other matters, the present full terms and conditions and the release of CAIT from all claims whatsoever, failing which the Grand Prize winner will be disqualified and will not be entitled to the Grand Prize;

iii. Changes to itineraries are not permitted;

9. The “Minor Rewards” are prizes awarded to the Eligible Participants who are not awarded the Grand Prize, but are identified as per the prize awarding process. Qualifying Entries will be considered for Minor Rewards.

10. The process for notifying and contacting winners and the claiming of the Prizes is as follows:-

10.1 Grand Prize

i. The Grand Prize winner will be notified via a “phone call and an email” on the mobile number and email id mentioned in the Qualifying Entry.

ii. If the Grand Prize winner fails to respond to the phone call or respond to the email for any reason within two (2) business days of CAIT sending the Grand Prize winner notification, the Grand Prize winner will be disqualified and have his/her Grand Prize forfeited and CAIT will be entitled to award the Grand Prize to an alternative Grand Prize winner;

iii. After receipt of the Grand Prize winner’s reply by CAIT a representative of CAIT or its appointed agency will contact the Grand Prize winner via the contact details provided by the Grand Prize winner to commence the booking process and finalize the redemption of the Grand Prize;

iv. The Grand Prize Winner will have twenty four (24) hours from being contacted to confirm and accept the travel details of the Grand Prize, failing which, CAIT and Mastercard reserves the right to disqualify the Grand Prize winner and forfeit the Grand Prize awarded to such Grand Prize winner and award the same to an alternative Grand Prize winner;

v. In connection with the claiming of the Grand Prize, CAIT shall be entitled to request proof from the Grand Prize winner of (i) him/her being an existing Card holder and/ or valid merchant acceptance point (Grand Prize winner will, confirm that he holds a valid Card in the Grand Prize winner’s reply) (ii) the purchase transaction involved in the entry being done with a Card through production of the relevant charge slip, and (iii) his/her valid photo identification.

10.2 Minor Rewards

The process for notifying and contacting the winners and the claiming of the Minor Rewards is as follows:-

i. The shortlisted Minor Reward winners will be notified via a “phone call and an email” on the phone number and email id mentioned in the Qualifying Entry.   

ii. Each shortlisted Minor Reward winner will be prompted to and must answer the phone and respond to the email within two (2) business days of the Minor Reward winner notification being sent to the Minor Reward winner in order to claim the Minor Reward;

iii. If a shortlisted Minor Reward winner fails to respond  to CAIT or its appointed agency, such Minor Reward winner will be disqualified and have his/her Minor Reward forfeited and CAIT will be entitled to award such Minor Reward to an alternative Minor Reward winner as stated in this terms and conditions;

iv. In connection with the claiming of the Minor Rewards, CAIT and its appointed agency shall be entitled to request proof from the Minor Rewards winner of (a) him/her being an existing  Card  and/ or valid merchant acceptance point (b) the purchase transaction involved in the entry being done with a Card, through production of the relevant charge slip, and (c) his/her valid photo identification. Failing due submission thereof, CAIT reserves the right to disqualify such Minor Reward winner and forfeit the Minor Reward awarded to such Minor Reward winner and award the same to an alternative Minor Reward winner selected as per the terms and conditions set out herein; and (d) CAIT or its appointed agency will inform the Minor Reward winner from whom he/she may collect the relevant components, as the case may be, of the Minor Reward.

11. Winner Announcement

The winners of the Prizes may be publicly announced by CAIT in the following manner, at its sole discretion:

i. The winners of the Minor Rewards may/will be announced on Win it for India website and CAIT website

ii. The winner of the Grand Prize may/ will be announced on Win it for India and CAIT website.

12. Prize Fulfilment

i. It shall be the responsibility of the winners to contact CAIT’s appointed Prize fulfilment agency to collect the Prizes.

ii. CAIT and Mastercard and its office bearers, employees, agents and other parties associated with the campaign shall not be liable to the winners under the Campaign or any other person for any deficiency, delay, omission, default or failure by any person or the fulfilment agency in collecting or distributing the Prizes.

iii. The Prizes and any component thereof cannot be transferred or exchanged or redeemed for cash, credit or any prizes and other items in part or in whole. The Prizes may be subject to additional terms and conditions accompanying them (if any). Mastercard and CAIT, may, at its sole discretion, at any time and without prior notice, replace or substitute any Prize or any component or item of any Prize with another component or item of a similar value.

13. Each Participant acknowledges that CAIT and/or Mastercard Group does not assume any responsibility for:

i. any Prizes offered under the Campaign;

ii. any products and services offered under the Campaign or related to or connected with any Prizes or any component or item thereof;

iii. the failure of any electronic communications in relation to delivery and/or receipt of entries, postings, winner notifications and other notifications whatsoever; and

iv. any entry, posting, notification or correspondence that is lost, late, misdirected, intercepted, undelivered, rejected, blocked, deleted or otherwise not received for any reason whatsoever.

14. Under no circumstances shall the inclusion of:

i. any Prize offered under the Campaign;

ii. any product or service offered under the Campaign or related to or connected with any Prize or any component or item thereof, be construed as an endorsement or recommendation of such Prize or product or service by the CAIT and Mastercard.

15. No representation or warranty of any kind is given by the CAIT and Mastercard as to the Prizes offered under the Campaign and all liability of any kind whatsoever is excluded to the fullest extent permissible by applicable law. In the event legislation mandates conditions or warranties which cannot be excluded, restricted or modified except to a limited extent, then to the extent permitted by law, the CAIT’s and Mastercard’s liability is limited to, at its option:

i. the replacement of the Prize or any component or item thereof or the supply of an equivalent prize; or

ii. the payment, if it does not contravene any law, of the cost of the replacement or supply.

16. The providers of the Prizes and the providers/suppliers of any other products and services offered under the Campaign or related to or connected with the Prizes or any component or item thereof are not agents, contractors, employees, servants, consultants or affiliates of the CAIT and Mastercard.

17. All risks associated with the collection, use and redemption of the Prizes and the travel to and from any venues and locations associated with the Prizes shall be assumed by the winners and their companions (if any). CAIT and Mastercard and their respective directors, officers, employees and agents shall not be liable to the winners or their companions (if any) under the Campaign or any other person for any deficiency, delay, omission or failure related to or connected with Campaign or the Prizes or any component or item thereof.

18. To the fullest extent permitted by applicable law, each Participant shall not have any claim whatsoever against any member of CAIT and Mastercard Group and their respective directors, officers, employees and agents in respect of any action, proceeding, judgment, damage or loss (including, without limitation, incidental, punitive, consequential, special, direct or indirect damages, loss of profits, loss of business, loss of business opportunity or economic loss), expense, injury (including, without limitation, death or personal injury), damage to property or liability suffered or incurred by the Participant (including any companion of the winner) or any other person arising from or in connection with:

i. such Participant’s participation in the Campaign;

ii. the collection, receipt, redemption, use or misuse of any Prize or any component or item thereof by such Participant and/or any other person; and

iii. the travel to and from any venues or locations associated with any Prize or any component or item thereof.

19. By participating in the Campaign, each Participant fully and unconditionally agrees to these terms and conditions and accepts that the decision of Mastercard, CAIT and Prize Adminstrator regarding the Campaign and all matters related to or connected with it, including, without limitation, the interpretation of these terms and conditions, is final and binding and no queries or claims which are inconsistent with such decision or interpretation shall be entertained. In the event all or any of these terms and conditions are not acceptable to a Participant, such Participant should not participate in the Campaign, notwithstanding the offer.

20. Each Participant shall indemnify and hold CAIT and Mastercard Group and their respective directors, officers, employees and agents harmless from and against any and all claims (including, without limitation, claims for negligence), liabilities, suits, damages, judgments, costs and expenses (including, without limitation, attorney’s fees) and all losses and expenses resulting or arising from or connected with any claims or actions by any third parties against  CAIT and Mastercard Group or any entity therein or their respective directors, officers, employees and agents due to any default, act, omission or negligence of such Participant, including, without limitation, default in complying with these terms and conditions or any violation of any applicable law, rules and regulations by such Participant.

21. CAIT and Mastercard Group and their respective directors, officers, employees and agents shall not, to the fullest extent permissible by applicable law, be liable in any way whatsoever in respect of any of the following:-

i. lost, late, misdirected, intercepted, undelivered, rejected, blocked or deleted entries, notifications, postings, correspondences or Qualifying Entry transaction postings;

ii. any Prize or any component or item thereof that is damaged, defaced, illegible, lost, stolen or otherwise not used;

iii. in accurate information provided by the Participant, howsoever caused;

iv. the suspension, cancellation or termination of the Campaign for any reason whatsoever;

v. virus or other corruption, technical or mechanical error or failure, human error, negligence or unauthorized human intervention in any part of the entry process, the winners’ selection or determination process, or the operation or administration of the Campaign;

vi. technical or mechanical errors related to computers, servers, mobile phones, satellites, telephone lines, network lines or any other equipment;

vii. non-receipt of entries, notifications, postings, correspondences or Qualifying Entry transaction postings; and

viii. any action, proceeding, judgment, liability, loss, injury, claim or damage (including, but not limited to, incidental, punitive, consequential, special, direct or indirect damages or losses, loss of profits, loss of business, loss of business opportunity, economic loss), expense, death and personal injury incurred or suffered by any Participant or any other person which may be caused, directly or indirectly, in whole or in part, from (a) any participation in the Campaign; (b) the collection, receipt, redemption, use or misuse of any Prize or any component or item thereof; or (c) the travel to and from any venues or locations associated with any Prize or any component or item thereof.

22. CAIT's records of all matters related to or connected with the Campaign shall be conclusive and binding on the Participants. CAIT and Mastercard’s decision on all matters relating to or connected with the Campaign (including, without limitation, the selection of winners) shall be final and binding on the Participants.

23. CAIT and Mastercard accepts no responsibility for any tax implications that may arise from any Prizes or any component or item thereof or the claiming, redemption and use thereof. Any tax filing obligation or any tax, rates or fee payment due to any authority as a result of the participation in the Campaign by a Participant or the collection, redemption, receipt or use of any Prize or any component or item thereof remains the sole responsibility of the winner thereof. It is the responsibility of each winner to seek independent advice on the possible implications this may have on his/her own financial situation.

24. CAIT and Mastercard (as mutually decided by the Parties) reserve the right to discontinue the Campaign at any time during the Campaign Period and in which case the Participants shall not have any claim whatsoever against CAIT and Mastercard.

25. Any of these terms and conditions may be changed, varied, modified and/or deleted by CAIT and Mastercard in its sole and absolute discretion at any time and from time to time without any prior notice to the Participants or to any other person and each Participant irrevocably and unconditionally accepts any such changes, variations, modifications and deletions.

26. The Campaign is subject to all applicable laws and regulations. In the event CAIT and Mastercard is  prevented from continuing with the Campaign or the integrity and/or feasibility of the Campaign is undermined by any event beyond the control of CAIT and Mastercard, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, breakdown in equipment, technical failures or other cause not reasonably within the control of CAIT and Mastercard, CAIT and Mastercard shall have the right, in its sole and absolute discretion, to abbreviate, modify, suspend, cancel or terminate the Campaign without any further obligation.

27. The Campaign cannot be clubbed with any other offer(s) or promotion(s).

28. The Campaign and these terms and conditions will be governed by the laws of India. In case of any dispute in relation to the Campaign, CAIT’s and Mastercard’s decision shall be final and binding.

29. If any of the provisions of these terms and conditions becomes or is invalid, illegal or unenforceable in any respect under applicable law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired and such invalid, illegal or unenforceable provisions shall be deemed severed from these terms and conditions and CAIT and Mastercard shall be entitled to replace such severed provisions with such other provisions as it may deem fit.

30. Each winning Participant under this Campaign may be required to sign a photography consent in a form provided by Mastercard.

31. In connection with conducting the Campaign, Mastercard will be using your payment card information and transaction information to select the winners of the Campaign. Mastercard will also be transferring the payment card information and transaction information that meet the Campaign eligibility criteria to its service provider and the bank that issued your payment card for the purpose of selecting and contacting the winners.
